When Can Rent Be Increased?
For periodic tenancies (month-to-month), landlords can increase rent once per year using a Section 13 notice, giving at least one month's notice. For fixed-term tenancies, rent can only increase if there's a rent review clause in the agreement, or when the fixed term ends.
Section 13 Notice
A Section 13 notice must: be in writing, specify the new rent amount, give at least one month's notice (for monthly tenancies), and propose a start date. The new rent must be fair and in line with market rates for similar properties.
How Much Can Rent Increase?
There is currently no rent cap in England (unlike Scotland, which has introduced rent controls). However, the increase must be fair and realistic. Typical annual increases are 3-8%, though landlords can propose any amount.
Challenging a Rent Increase
If you think the increase is unfair, you can: negotiate directly with your landlord, apply to a First-tier Tribunal (Property Chamber) to determine a fair rent, or give notice and move. The tribunal will assess the market rent for comparable properties.
Rent Increases in Social Housing
Social housing rents are regulated and increase annually by CPI + 1%. This is set by the government and applies to housing associations and councils.
Tips for Tenants
Keep records of all rent increase communications. Research comparable rents on Rightmove and Zoopla before negotiating. Being a reliable, long-term tenant gives you negotiating leverage. Consider offering a longer tenancy in exchange for a smaller increase.
